These Terms and Conditions (“Terms”) govern your use of Sage James, including the website located at https://captaincarl.net, the Captain Carl AI chat application, and related services.
By accessing or using Captain Carl, you agree to these Terms. If you do not agree, do not use the service.

Captain Carl provides an AI-powered chat and productivity service that may allow users to send messages, upload files, upload images, save chats, and receive AI-generated responses. Captain Carl may offer free and paid plans with different features, limits, models, or capabilities.

6. No Professional Advice
Captain Carl does not provide legal, medical, financial, engineering, emergency, or other professional advice. Do not rely on AI output as a substitute for qualified professional guidance.
7. Prohibited Uses
You agree not to use Captain Carl to violate laws, infringe rights, upload malware, disrupt the service, bypass limits or payment requirements, commit fraud, impersonate others, collect data without permission, or submit illegal, abusive, hateful, exploitative, or harmful content.
8. File and Image Uploads
You are responsible for uploaded content. Do not upload confidential, sensitive, illegal, harmful, copyrighted, or private information unless you have the right to do so and accept the risks of processing that content.
9. Paid Plans, Billing, and Subscriptions
Captain Carl may offer paid plans. Prices, features, and limits may change over time. Payments may be processed by a third-party provider such as Stripe. Unless otherwise stated, subscriptions may renew automatically until canceled. Refunds are not guaranteed unless required by law or expressly stated by Captain Carl.
10. Availability and Changes
We may modify, update, suspend, or discontinue any part of Captain Carl at any time. We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.
11. Intellectual Property
Captain Carl, including its name, website, software, branding, design, and related materials, is owned by us or our licensors. You may not copy, modify, sell, resell, or exploit any part of the service without permission.

You agree to defend, indemnify, and hold harmless Captain Carl and its owners, operators, employees, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from your use of the service, your content, or your violation of these Terms.
17. Governing Law
These Terms are governed by the laws of the State of Texas, unless applicable law requires otherwise. Any disputes will be handled in the appropriate courts located in Texas, unless another venue is required by law.

We may update these Terms from time to time. Continued use of Captain Carl after changes means you accept the updated Terms.
